Tatua’s Holiday Pay Remediation
Like many other companies around New Zealand, we have reviewed our practices in response to general concerns raised about how companies have interpreted the Holidays Act 2003. We have discovered past miscalculations to some of our employees. Here’s everything you might need to know.
In 2017 we approached our payroll provider to gain reassurance that the amounts paid when annual leave was taken were correct and compliant with the Holidays Act. At that time, we were reassured that we were calculating leave correctly.
When we changed to a new payroll provider, though, we brought in an external consultancy – Integrity1 – to audit our payroll data in April 2019. They presented their findings to us in a report on 10 May 2019. They found that we had indeed been calculating some payments incorrectly.
We’ve reviewed all employees’ payroll history. Some employees have been overpaid or underpaid holidays, while for many others we’ve correctly applied the Holidays Act.
Since discovering this, we’ve worked hard to verify the information for each individual employee, past and present. We have also worked extensively with Zambion to ensure that we can be confident the current calculations used are compliant. We confirm to you they are. We have also engaged with the DWU and Etu unions to make them aware of what we’ve discovered, the work completed to date, and our plans to remediate or put things right.
We have now identified all past and present employees affected by the miscalculations. We’ve applied the correct calculations, and so we now have exact amounts owed to each affected employee. We’re now making every effort to contact these people so we can pay them the monies owed.
